Refund policy

Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have a statutory period of 14 days from receipt of your order to exercise your right of withdrawal. Dansezo extends this period to 30 days from receipt of your order: you may exercise your right of withdrawal for 30 days, without having to give any reason or bear any penalty.

Where an order includes several goods delivered separately, the period runs from receipt of the last item.

How to exercise your right of withdrawal

You may exercise your right of withdrawal before the 30-day period expires by clearly informing us of your decision.

You may notify us of your decision by email at contact@dansezo.fr, stating your order number and the products concerned.

You may also use the model withdrawal form below. Use of this form is not mandatory.

Where the online withdrawal function is available on our website, you may also use it directly from the interface provided for this purpose.

Returning products

After informing us of your decision to withdraw, you must return the products concerned without undue delay and, at the latest, within 14 days of communicating your decision to withdraw.

Return address

To make a return, please contact us at contact@dansezo.fr before sending anything.

We will email you the return address for your order along with the necessary instructions.

Please do not send any parcel to an address that has not been provided by Dansezo for your return.

Return conditions

You may try the product under conditions that allow you to check its nature, characteristics and proper functioning. Shoes, in particular, may be tried on indoors, on a clean and suitable surface.

The product must not have been worn outdoors or handled beyond what is necessary to establish its nature, characteristics and proper functioning.

Where possible, products should be returned with their original tags and packaging so that they can be resold in the best possible condition.

You are liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.

The direct cost of returning the products is borne by the customer when exercising the right of withdrawal, except where the product is defective or not as described, or where the error is attributable to Dansezo.

Refunds

If the right of withdrawal is validly exercised, Dansezo will refund all sums paid by the customer, including the initial delivery costs corresponding to the standard delivery method offered at the time of the order.

Additional costs resulting from the customer's choice of a more expensive delivery method than the standard one offered are not refunded.

The refund will be made no later than 14 days from the date on which Dansezo is informed of the customer's decision to exercise their right of withdrawal.

Dansezo may, however, defer the refund until it has received the products or until the customer provides proof that they have been shipped, whichever of these events occurs first.

The refund is made using the same payment method as the one used for the initial transaction, unless the customer expressly agrees to a different payment method and provided that the customer is not charged any fees as a result of the refund.

Exchanges

First size exchange free of charge. If the size of your shoes doesn't fit, write to us within 30 days of receipt at contact@dansezo.fr, stating your order number and the size you would like. We will send you the correct size of the same model free of charge, without you having to send back the first pair. This free exchange is limited to one exchange per order, for the same model, subject to availability of the requested size.

To change to a different model or product, or to obtain a refund, you may exercise your right of withdrawal under the conditions set out above, and then place a new order.

Products excluded from the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised, nor to other categories of goods or services expressly excluded by law.

Items that are on promotion, on sale or discounted remain subject to the statutory right of withdrawal where no legal exception applies to them.

Defective or damaged products, or order errors

If you receive a product that is defective, damaged or not as ordered, or if an error has been made by Dansezo, please contact us as soon as possible at contact@dansezo.fr, stating your order number and, if possible, attaching photographs of the product concerned.

These situations are handled separately from the right of withdrawal and do not deprive the consumer of the benefit of the applicable statutory guarantees.

Statutory guarantees

Independently of the right of withdrawal, the products benefit from the statutory guarantees provided for by law.

  • Statutory guarantee of conformity: in accordance with Articles L217-3 et seq. of the French Consumer Code, the consumer benefits from the statutory guarantee of conformity under the conditions provided for by law.
  • Statutory guarantee against hidden defects: in accordance with Articles 1641 et seq. of the French Civil Code, the consumer benefits from the guarantee against hidden defects under the conditions provided for by law.

These guarantees apply independently of the right of withdrawal.

Legal notice: statutory guarantee of conformity and guarantee against hidden defects

The consumer has a period of two years from delivery of the goods to enforce the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the statutory guarantee applies to that digital content or digital service throughout the supply period provided for. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The statutory guarantee of conformity entails an obligation for the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller insists on replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and obtain a full refund against return of the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of collecting or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are out of use for the purpose of repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who acts in bad faith to obstruct the enforcement of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

The seller responsible for these guarantees is Dansezo, sole proprietorship Naim Ghandour, 79 rue de Belfort, 61100 Flers, France. To enforce them: contact@dansezo.fr or 06 21 68 92 91.
